1. INTRODUCTION AND ACCEPTANCE OF TERMS
Welcome to ProNow. These Terms and Conditions (“Terms”, “Agreement”) govern your access to and use of the ProNow mobile application (“App”), available on the Apple App Store and Google Play Store, operated by ProNow (“Company,” “we,” “us,” or “our”). You must be at least 13 years of age (13+) to use the ProNow App. By downloading, installing, accessing, or using the App, you (“User,” “you,” or “your”) represent that you meet this minimum age requirement and agree to be bound by these Terms. If you do not agree to these Terms or are under 13 years of age, you must not access or use the ProNow App.
2. NATURE OF PRONOW SERVICES
ProNow operates solely as a technology facilitator. The App provides a live, approved, and trusted technology platform designed to connect consumers (“Customers”) seeking professional services with independent third-party businesses and freelancers (“Service Providers”) who sell services.
ProNow is not a service provider, contractor, employment agency, or marketplace merchant. ProNow does not sell, perform, control, manage, or employ personnel for any of the underlying services offered through the App. The contract for the purchase and delivery of any service is strictly between the Customer and the Service Provider. ProNow acts merely as an intermediary platform facilitating this global economic relationship.
3. VERIFIED BUSINESS ELIGIBILITY
To maintain platform safety, quality, and trust, only verified and trusted businesses are permitted to offer and sell services to Customers on the ProNow platform. ProNow reserves the right to screen, vet, suspend, or terminate any Service Provider account at any time if they fail to meet our verification standards or operational criteria.
4. REAL BUSINESS TRANSACTIONS & BANKING RESPONSIBILITIES
Participants are reminded that all interactions conducted on ProNow represent binding, real business transactions using approved, real banking infrastructure.
- Documentation: Each Customer and Service Provider is independently responsible for maintaining, filing, and keeping their own records, invoices, receipts, tax documentation, and proof of transaction.
- Transaction Limits: To maintain platform security, risk mitigation, and compliance with processing standards, no single transaction or booking processed through the ProNow App may exceed $10,000 USD (Ten Thousand United States Dollars). ProNow reserves the right to decline, cancel, or reverse any transaction that attempts to exceed this threshold or circumvent payment processing policies.
5. APP STORE & PAYMENT PROCESSING TERMS
To the extent that you access or download the App via the Apple App Store or Google Play Store, or utilize in-app purchasing/billing mechanisms provided by those platforms, you agree to comply with all applicable third-party terms of service and billing rules of Apple, Inc. or Google LLC, respectively. Payments, refunds, or subscription cancellations processed through Apple Play Billing or Google Play Billing are subject to the policies of those store operators.
6. USER CONDUCT & CONTENT MODERATION
ProNow maintains a strict policy of zero tolerance for illegal, abusive, harassing, defamatory, fraudulent, or objectionable behavior or content. Users agree not to post, send, transmit, or upload any content that infringes upon third-party rights or violates platform rules. ProNow reserves the absolute right, without prior notice, to filter, moderate, remove, or flag non-compliant user-generated content, as well as to suspend or permanently block any account violating these standards.
7. DISCLAIMER OF WARRANTIES
To the fullest extent permissible under applicable law, the ProNow App and all services facilitated through it are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory. ProNow makes no representation or warranty that the App will operate uninterrupted, error-free, or fully secure, or that any defects will be corrected immediately.
8. GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION
- Applicable United States Law: These Terms, and any dispute, claim, or controversy arising out of or relating to your use of the App, shall be governed by and construed in accordance with the laws of the United States of America.
- Local Law Compliance: Users acknowledge that local laws, regulations, and licensing rules apply in the specific geographic area where you are physically located and where the services are rendered or consumed.
- Fast Resolution Goal: In the event of any disagreement, claim, or dispute between Users or between any User and ProNow, the explicit goal is fast, fair, and efficient resolution. Parties agree to attempt informal negotiation and expedited dispute mechanisms before initiating formal litigation.
9. DATA PRIVACY AND GOOGLE MAPS SERVICES
ProNow values your privacy and is committed to protecting your personal information. ProNow does not sell, rent, trade, or monetize Customer data to third parties in any way. Any data collected through the App is used solely to facilitate platform functionality, complete transactions, ensure user security, and improve our services.
DO WE USE GOOGLE MAPS?
In Short: Yes, we use Google Maps and the Google Geocoding API for the purpose of providing better service.

By using our Maps API Implementation, you agree to be bound by Google’s Terms of Service. By using our implementation of the Google Maps APIs, you agree to allow us to gain access to information about you including personally identifiable information (such as usernames) and non-personally identifiable information (such as location). We will be collecting the following information: ProNow Customer Service Address via Geocoding API.
For a full list of what we use information for, please see the previous sections titled “Use of Your Information” and “Disclosure of Your Information.” You agree to allow us to obtain or cache your location. You may revoke your consent at anytime. We use information about location in conjunction with data from other data providers.
The Maps APIs that we use store and access cookies and other information on your devices. We currently do not serve users in the European Union.
10. INDEPENDENT CONTRACTOR RELATIONSHIP
Service Providers utilizing ProNow are independent business entities or freelancers. Nothing in these Terms creates a partnership, joint venture, agency, or employer-employee relationship between ProNow and any Service Provider or Customer. ProNow is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Service Provider or Customer, nor for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
11. ACCOUNTS AND PLATFORM INTEGRITY
To use certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account. ProNow reserves the right to suspend or terminate accounts that violate platform rules or engage in fraudulent activity.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, ProNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the App or any services purchased through the platform.
13. AMENDMENTS TO TERMS
ProNow reserves the right to modify or update these Terms at any time. We will notify users of any material changes by updating the “Last Updated” date at the top of these Terms or through in-app notifications. Continued use of the App following any updates constitutes your acceptance of the revised Terms.
